When commercial fishermen asked the Nova Scotia Supreme Court to formally declare whether or not Indigenous lobster trappers were exempt from federal fishing rules, the court dismissed the case before it could proceed to trial. “So, the question as to whether the rules actually apply to Indigenous people remains unanswered,” Sarkonak writes.
