Kevin Costner was sued by a stuntwoman, Devyn LaBella, with claims that she was forced to partake in an unscripted and unscheduled rape scene on the set of the movie "Horizon."

She claims that while directing the scene, Costner engaged in unruly sexual conduct towards her, making her very uncomfortable. The lawsuit carried ten counts of sexual harassment charges.
The charges have now been reduced to eight counts as the judge recently tossed out two of her claims. Costner's lawyer, Marty Singer, spoke to TMZ earlier this month, revealing his intention to appeal the judge's decision.

On Thursday afternoon, Costner appealed, seeking dismissal of all eight other claims. Initially, the actor filed a motion to dismiss the case in August after insisting that there was no violent rape scene on his set.

Singer then revealed that although he was confident that the case did not stand a chance, he was still disappointed that the other claims were not dismissed at the time. He further expressed optimism that the truth will prevail.
He insisted that the stuntwoman's accusations were outrageous and that there was no simulated rape, sex, or retaliation. As reported by The Blast, the lawyer revealed that it was only a cash grab on her end, as she was fully aware of what she was getting into by participating in the scene.

In her lawsuit, LaBella explained that Costner's conduct during the rape scene affected her psychologically. She disclosed that the emotional effects weighed on her, adding to the fact that this took place while she was on her period.
She also claimed that one of the actors on set rested his hands above her vagina between takes, and this was extremely uncomfortable. The scene was filmed without an intimacy coordinator, and when she asked why, her questions went unanswered.
LaBella emphasized that her version of the story was accurate and had not changed since she first told it in 2023, as she had no reason to lie and was under oath.

Costner Slammed The Stunt Performer's Narrative
MEGACostner, in response to LaBella's claims, insisted that she gave a false account of events. He reportedly noted that her body language on set was the opposite of what she alleged in her filings.
He also claimed that after shooting the scene, she sent a text to the supervisor on set appreciating him for the good time she had while filming. LaBella previously revealed she sent a text to the set coordinator, but it was to voice out her complaints about the uncomfortable situation that occurred.
"I wanted to discuss yesterday's abomination when we both have a chance ... I was put in a really wrong position and it's really affected me," the alleged text read.
The actor added that there was no nudity, physical contact, or simulated sex between the actors, thereby insisting that her claims were all bogus.
